Tycoon’s showdown with ‘wife’ hits Supreme Court

A lawyer for Lay Huong, the former common-law wife of tycoon Khaou Phallaboth, yesterday urged the Supreme Court to uphold decisions made by both the Phnom Penh Municipal Court and the Appeal Court and dismiss a “breach of trust” complaint lodged against her by her ex-partner.

Phallaboth accuses Huong of unlawfully acquiring land in Mondulkiri via the company Khaou Chuly Development, a firm once co-owned by the pair, the court heard.

Further, he alleged that Huong, 59, used the company’s equipment – including bulldozers, gasoline and rubber saplings – to clear and develop the land for her own private gain.

Two former employees of Khaou Chuly Development – Heng Sok, 51, and Lay Chhay, 44 – are being tried as accomplices.
The case was dismissed by both lower courts. Unhappy with the verdict, Phallaboth, via his lawyer Nheb Sokhoeum, pursued the matter to the Supreme Court. In a submission to the hearing, Sokhoeum, who was yesterday absent, called the previous decisions to drop the case “unfair”.

Meanwhile, lawyer for the accused Chea Chanravy asked the judges to drop the complaint, a position backed by deputy prosecutor Ouk Kimseth, who said Huong was within her rights to buy the land and use the machinery.

Huong and Phallaboth – convicted earlier this year for orchestrating the attempted rape and murder of the wife and daughter of Transportation Minister Sun Chanthol – have been engaged in a long-running legal battle following a messy split in 2013.

City Hall yesterday rejected the opposition’s request to hold the funeral of former Prime Minister Pen Sovann at Phnom Penh’s Wat Botum Park, saying he ceased to enjoy any special privileges after becoming a lawmaker in the 2013 election.

“That was the past, but now it is the present and things are different,” said City Hall spokesman Mean Chanyada. “Currently he is a lawmaker, therefore we treat him like a lawmaker.”

Sovann, who was Cambodia’s first premier following the fall of the Khmer Rouge, passed away on Saturday night after a prolonged battle with poor health and will lay in wake at his family home in Takeo province. He was serving as a Cambodia National Rescue Party lawmaker for Kampong Speu province.

Chanyada said the municipality had yet to receive a request for a funeral march from Takeo to Chamkarmon district’s Wat Khan or for holding the cremation ceremony at Wat Botum, adding that the site was reserved for officials who were ranked deputy prime ministers and above.

“There is no discrimination. Even ministers cannot be cremated there,” Chanyada said. CNRP lawmaker Yem Ponhearith said it was “regrettable” that the authorities were ignoring Sovann’s past contributions to the country and that even lawmakers could be honoured for their service. “They should honour all Cambodian ministers the same, whether past or present,” he said.

In the wake of Sovann’s death, the CNRP must now fill one of the three National Assembly seats they won from Kampong Speu province in 2013 – Sok Umsea and Nuth Rumdoul are the other two sitting lawmakers.

According to the Law on the Election of Members of the National Assembly, the party is to nominate a new member to fill in the vacancy from the broader list of candidates originally submitted for that province.

CNRP spokesman Yim Sovann said the party – following its list from the 2013 election – would propose Soun Rida to take over the seat. He said Rida, who is a doctor by profession, currently serves as vice chairman of the party’s Phnom Penh working committee.

“There is no need for discussion because we have to follow whoever is fourth on the list,” Sovann said.

“I don’t think we will change that, and it will happen after the funeral.”

เวลา 22.45 น.วันที่ 31 ตุลาคม ศูนย์วิทยุ สภ.หัวหิน ได้รับแจ้งมีเหตุเพลิงไหม้ อาคารเรือนแก้งนวดแผนไทย แอนด์ สปา ริมถนนเพชรเกษมอำเภอหัวหิน จังหวัดประจวบคีรีขันธ์ หลังรับแจ้งแล้ว พ.ต.อ.สิทธิชัย ศรีโสภาเจริญรัตน์ ผกก.สภ.หัวหิน พร้อมเจ้าหน้าที่ตำรวจ สภ.หัวหิน และ นายนพพร วุฒิกุล นายกเทศมนตรีเมืองหัวหิน พร้อมรถดับเพลิงเทศบาลเมืองหัวหิน จำนวน 12 คัน พร้อมเจ้าหน้าที่และเจ้าหน้าที่มูลนิธิกู้ภัยหัวหิน เดินทางไปยังที่เกิดเหตุ บริเวณปากซอยหัวหิน 96 เพลิงกำลังลุกไหม้ตัวอาคารร้านเรือนแก้วนวดแผนโบราณ อยู่บริเวณชั้นที่ 2 ซึ่งเป็นด้านหน้าของอาคารซึ่งเป็นลักษณะทรงไทย เจ้าหน้าที่ตำรวจต้องปิดการจราจรฝั่งขาเข้าหัวหิน และให้ใช้เส้นทางเลี่ยงแทนเพื่อความปลอดภัย ขณะที่นายกเทศมนตรีเทศบาลเมืองหัวหิน ได้สั่งการให้เจ้าหน้าที่ดับเพลิง ระดมฉีดน้ำสกัดเพลิงที่กำลังโมลุกไหม้อย่างรวดเร็ว เนื่องจากบริเวณดังกล่าวเป็นอาคารพาณิชย์และร้านค้า ห้างร้านต่างๆ และบ้านเรือประชาชน ท่ามกลางประชาชนที่ทราบต่างออกมาดูเหตุการณ์เพลิงไหม้ ซึ่งเจ้าหน้าที่ดับเพลิงส่วนหนึ่งต้องปีนเข้าไปในอาคารที่เกิดเหตุเพลิงไหม้ทางด้านข้าง เพื่อฉีดน้ำสกัดเพลิงไว้ได้เมื่อประมาณ 01.00 น.และเปิดการจราจรในเวลาต่อมา
เบื้องต้นพ.ต.อ.สิทธิชัย ศรีโสภาเจริญรัตน์ ผกก.สภ.หัวหิน กล่าวว่าเบื้องต้นรายละเอียดยังไม่ทราบว่าต้นเพลิงเกิดจากสาเหตุอะไร โดยได้แจ้งเหตุเพลิงไหม้เกือบ5ทุ่มคืนที่ผ่านมา ต้องรอเจ้าหน้าที่ตำรวจพิสูจน์หลักฐานเข้าตรวจสอบในวันพรุ่งนี้ ซึ่งได้จัดตำรวจดูแลโดยรอบบริเวณอาคารดังกล่าวและห้ามมิให้บุคคลภายนอกและเจ้าของเข้าไปภายในอาคารดังกล่าวโดยเด็ดขาด ซึ่งทราบเพียงว่าร้านนวดแผนโบราณแห่งนี้ได้ปิดร้านตั้งแต่วันที่ 30 ตุลาคม จนถึงวันที่ 1 ตุลาคม เพื่อปรับปรุงเท่านั้นในเบื้องต้น ส่วนสาเหตุต่างๆจะให้พนักงานสอบสวนหาสาเหตุต่อไปเบื้องต้น ขณะนี้ยังไม่สามารถประเมินค่าเสียหายได้

MANILA, Philippines (AP) -- The foul-mouthed Philippine president, who once called the pope a "son of a bitch" and told Barack Obama to "go to hell," says he has promised to God he won't spew expletives again.

President Rodrigo Duterte's profanities have become a trademark of his political persona, especially when threatening to kill drugs dealers as part of his war on illegal drugs that has left thousands dead since he took office at the end of June.

Duterte made the stunning pledge on arrival in in his southern hometown of Davao city late Thursday from a trip to Japan.

He said that while flying home, he was looking at the sky while everyone was sound asleep and he heard a voice that said "'if you don't stop epithets, I will bring this plane down now."



"And I said, 'Who is this?' So, of course, 'it's God,'" he said.

"So, I promise God to ... not express slang, cuss words and everything. So you guys hear me right always because (a) promise to God is a promise to the Filipino people."

Duterte's vow was met with applause, but he cautioned: "Don't clap too much or else this may get derailed."
