The Ministry of Social Affairs yesterday confirmed it would construct a new national facility to rehabilitate child offenders.

The news follows a meeting last Thursday when spokesman Touch Channy told attendees that the new centre to detain juvenile offenders would be built following the recent adoption of the Juvenile Justice Law. The bill was signed into law by King Norodom Sihamoni in July.

“This law protects the children under a certain age [18-years-old],” Channy said yesterday. “With this law we don’t keep those children at the prisons; we keep them at the rehabilitation centres.”

Channy could not name the kinds of services that would be offered or a specific timeframe for the building’s completion, but said juveniles who broke the law would be “educated”.

Huy Hoeurn, the deputy-general of prisons, welcomed the news about the centre. He said it was sorely needed as he had witnessed children as young as 12 – below the age of criminal responsibility threshold of 14 – being detained alongside adult female prisoners at Prey Sar.

“At the prison now there is no proper system to educate those underage children for the wrongdoing; there is hardly anything to make them reform,” Hoeurn said.

Nhep Sopheap, the secretary-general of the National Cambodian Council for Children, said the juvenile detention centre would be located at the Khmer-French-Hungarian Friendship Orphanage Centre in Kandal province.

“It’s going to be a national rehabilitation centre. This is our priority. Of course there is demand at the provincial level also,” Sopheap said. “What we are lacking now is training and education for social workers.”

The Kandal orphanage is the same site, Channy announced in July, where people with mental disabilities currently detained at the capital’s notorious Prey Speu detention centre would be moved.

However, Billy Gorter, of This Life Cambodia, a juvenile rehabilitation NGO, said it was paramount that children were not detained alongside adults.

“Children should always be separated from adults in detention facilities and, foremost, provided robust therapeutic interventions to meet each child’s individual needs,” he said via email. He added that the new law lacked some clarity on how “diversion” away from the criminal justice system would be implemented.

“Considering the government is committing to keeping children in families and reducing the number of children in institutions, such legislation leaves a lot of room for interpretation if parents or guardians are unable to be traced in the first instance,” Gorter said.

“We would hope that detention of any individual, especially children under the age of 18, was a last resort and [only] after all other alternatives had been explored,” he said.

Spokespeople from UNICEF and Save the Children declined to comment yesterday.

A month after the Cambodian Human Rights Committee sent a request to its Thai counterpart asking it to implement safety measures to protect Cambodians working in often slave-like conditions on Thai boats, the committee yesterday received a response claiming Thai authorities had long ago taken sufficient action.

In its letter, the National Human Rights Commission of Thailand defended the Thai government’s work, pointing to the ongoing registration of undocumented migrant workers, the establishment of a council dealing with human trafficking and a list of recommendations made to the Thai government last year.

However, the ongoing rampant abuses on Thai boats contradicted the body’s claims, said Dy The Hoya, program officer with labour rights group Central. “I think the Thai government just wanted to shore up its good image with the international community, that it really takes serious measures against perpetrators of fishing boat slavery,” he said. “In fact, it’s just in writing – no clear mechanism and strong commitment.”

Keo Remy, president of the Cambodian Human Rights Committee, didn’t respond to requests for comment.

Phil Robertson, deputy Asia director of Human Rights Watch, said the Thai human rights commission has “been really a bit player in the larger policy discussions about abuses of Cambodian fishers Thai boats, which is unfortunate”

Islamabad (NDTV): A Pakistan court today ordered the confiscation of Pervez Musharraf's property after the former dictator "persistently failed" to appear in the case involving the killing of a cleric during the 2007 Lal Masjid operation.

A sessions court in Islamabad is trying the 73-year-old, who is currently in Dubai for 'medical treatment', over killing of Abdul Rasheed Ghazi when army stormed the Lal Masjid in the heart of the city.

Additional District and Sessions Judge (West) Pervaiz ul Qadir Memon ordered confiscation of former Pakistan President's properties under Section 88 of the Code of Criminal Procedure (CrPC), a lawyer said.

"The court ordered confiscation of property as the court said Musharraf persistently failed to appear in the case," according to lawyer Tariq Asad, who represented the cleric.

The court also rejected a plea by Gen Musharraf's lawyer, Akhtar Shah, who had contended that since army was acting in aid of civilian administration during Lal Masjid operation, hence, no criminal case could be filed against any official of the armed forces.

Gen Musharraf, who has been living in Dubai since March, has not appeared even a single time in the court despite warnings. The former military ruler flew to Dubai for purported medical treatment after the Supreme Court lifted the ban on his foreign trips and it is believed that he may never return to face a slew of several high-profile cases against him.

The court declared him a proclaimed offender and confiscated surety bonds of Rs. 200,000 this year.

A case was registered against former Army chief in 2013 for alleged role in killing of Ghazi.

Gen Musharraf was President of Pakistan 1999 to 2008 when he stepped down after his supporters lost elections. He lived in Dubai and returned in 2013 to take part in elections but was embroiled in several criminal cases including high treason for abrogating the constitution in 2007.

In January this year, Gen Musharraf was acquitted by court for alleged role in killing of Baloch rebel leader Nawab Akbar Bugti in 2006.

ICC move fuels debate on Cambodian case

A new paper from the International Criminal Court laying out a shift in focus to crimes linked to environmental destruction and the unlawful dispossession of land has rekindled the debate over whether the court will launch an investigation into a case highlighting land-grabbing in Cambodia.

In light of Thursday’s policy paper, British lawyer Richard Rogers – who has filed a complaint asking the ICC to investigate Cambodia’s “ruling elite” for its role in land-grabbing, political persecution and a host of other crimes – said it was only a matter of time before the court opens a preliminary examination of Cambodia.

“In my view, the change of policy to include crimes relating to dispossession of land is a clear indication that the ICC prosecutor is getting ready to move on the Cambodia case,” Rogers said. “These cases are now priority cases for Ms [Fatou] Bensouda, the ICC prosecutor . . . so it would be surprising if she made this major policy change but did not follow through.”

According to Rogers’s law firm, Global Diligence, about 830,000 Cambodians have been adversely affected by land disputes.

Responding to the court’s policy shift, Human Rights Watch representative Phil Robertson said it was “very encouraging” that the ICC is taking land-grabbing seriously, but noted that it didn’t imply Cambodia’s government will put an end to the practice.

“This is a huge problem in Cambodia, it undermines development and is one of the most damaging policies,” Robertson said. “But I don’t think the government is committed to reversing the policy because there’s no indication they think they’ve done anything wrong.”

“It goes to show how oblivious they are,” he added.

However, international cri­minal law expert William Schabas cautioned that the policy paper’s significance is being “greatly exaggerated”.

“The paper mentions factors that the prosecutor would consider in selecting cases . . . But [in 2003] her predecessor said the same thing about economic factors, and he never did anything,” Schabas explained.

Though an investigation into the Cambodian case is unlikely, the decision will ultimately depend on the personal judgment of the prosecutor, he added. “People are going to be disappointed if they think this signifies some big shift.”

The Khmer Rouge tribunal trial chamber has upheld a decision that rapes that occurred at three security centres will not be reclassified at crimes in their own right, according to a document made public late last week.

The decision – which referred to the chamber’s prior stance that there is “no legal basis” to charge former leaders Khieu Samphan and Nuon Chea with rape outside the context of forced marriage – was delivered in response to an application from the lead co-lawyers for civil parties to clarify the scope of Case 002/02.

Lawyer Marie Guiraud said this clarification was necessary, as a court filing by the prosecution said the accused were not charged with rape. Her team believes the pair were charged with rape at the pre-trial stage in 2009 and indicted with rape in the 2010 Closing Order.

“It is our understanding that Case 002/02 encompasses factual allegations that could amount to rape, mainly in Tram Kok cooperative, S-21 and Kraing Ta Chan security centers,” she said via email, referring to centres named in the Closing Order.

In their decision, the trial chamber said: “The Closing Order concluded that rape outside the context of forced marriage could not be considered as ‘one of the crimes used by the CPK [Communist Party of Kampuchea] leaders to implement the common purpose’.”

The Chamber claimed if the request was granted, it “would have the effect of adding new charges”, and declined to recharacterise the factual allegations of rape at the security centres as crimes; however, Giraud stressed her request was for clarification, not for the “recharacterisation of the facts”.

ส่วนที่จ.กำแพงเพชร นายธานี ธัญโภชน์ ผู้ว่าราชการจังหวัด ลงพื้นที่ต.ไตรตรึงษ์ อ.เมือง จ.กำแพงเพชร หลังน้ำล้นคลองเข้าท่วมชุมชนและถนน 3 วัน ล่าสุดน้ำเริ่มลดลง ขณะที่ทางจังหวัดเตรียมแก้ไขปัญหาระยะยาว ด้วยการเพิ่มท่อระบายน้ำ บริเวณชุมชนและทางหลวง เจ้าหน้าที่สำนักชลประทานที่ 3 เร่งสูบน้ำออกจากทุ่งนา ต.เขาดิน อ.เก้าเลี้ยว และต.หนองกระโดน อ.เมือง จ.นครสวรรค์ หลังฝนตกหนัก ทำให้น้ำท่วมนาข้าวกว่าหมื่นไร่
สำหรับภาคใต้ นายเฉลิมศักดิ์ ภูวญาณพงศ์ ป้องกันและบรรเทาสาธารณภัยจังหวัดกระบี่ ประกาศเตือนเรือทุกประเภทให้ระวังอันตรายจากคลื่นลมแรงในระยะนี้ ส่วนประชาชนที่อาศัยในพื้นที่เสี่ยงทั้ง 8 อำเภอ ให้เฝ้าระวังอันตรายจากดินโคลนถล่ม เนื่องจากมีฝนตกสะสม ดินอุ้มน้ำไว้มาก
ขณะที่หาดปากเมง ต.ไม้ฝาด อ.สิเกา จ.ตรัง ร้านค้าต้องปิดให้บริการ หลังลมพัดแรงทำให้ข้าวของและร้านค้าริมหาด เสียหายบางส่วน ส่วนบรรยากาศการท่องเที่ยวยังไม่คึกคักมากนัก
ทั้งนี้ ศูนย์อุตุนิยมวิทยาภาคใต้ฝั่งตะวันตก คาดการณ์ว่าในช่วงวันที่ 19-22 กันยายนนี้ มรสุมตะวันตกเฉียงใต้ ที่พัดปกคลุมทะเลอันดามันและภาคใต้จะมีกำลังแรง ทำให้บริเวณภาคใต้มีฝนตกเพิ่มขึ้น ส่วนคลื่นลมในทะเลอันดามันมีกำลังแรง สูง 2-3 เมตร จึงขอให้ประชาชนและชาวเรือระมัดระวังอันตรายจากฝนตกหนักและคลื่นลมแรงด้วย
